Terms and Conditions

1. General

“ICS” means, Indian Courier Service International L.L.C and its branches.
By giving this shipment to ICS for carriage, the sender and anyone else with an interest in the shipment agree to the terms and conditions of ICS.
ICS reserves the right to refuse documents or parcels from anyone at its sole discretion, and to hold, cancel, postpone or return any Shipment at any time if such Shipment would in the ICS’s opinion be likely to cause damage or delay to other Shipments, goods or persons, or the carriage of which is prohibited by law or is in violation of any of these Conditions.
 

2. Limitation of liability

ICS’s liability is limited to ONE HUNDRED AED (AED 100.00) or the declared value of the shipment whichever is lower unless the sender opted for insurance by paying an extra fee to ICS.

3. Inspection

ICS may, at its sole discretion open and inspect any Shipment without notice at any time for safety, security, customs or other regulatory reasons and shall incur no liability of any kind therefore. 

4. Prohibited goods

Firearms, ammunition, explosives, explosive devices or replica or imitation firearms; counterfeit goods; bullion, precious metals and stones;live animals and plants, animal parts or remains, such as ivory; human remains or ashes; narcotics or other illegal drugs; Perishable requiring refrigeration or other environmental control;obscene materials;money, including but not limited to cash and cash equivalents (e.g. negotiable instruments, endorsed stocks, bonds and cash letters), collectible coins and stamps;goods prohibited by any law, regulation or state or local government of any country from, to or through which it may be carried.

5. Undeclared and Hidden goods

ICS reserves the right at its sole discretion to confiscate, dispose goods which are hidden intentionally or not declared by the shipper and charge the shipper with penalties and fines.

6. Duties, Taxes & Fees

ICS rates do not include duties, taxes, customs clearance Charges, or any other import or export Charges applicable to the Shipment. So, the shipper or receiver must pay them wherever applicable.
We reserve the right at our sole discretion to charge you with any penalties, fines, damages or other costs or expenses, including but not limited to storage fees, resulting from an enforcement action by any competent government authority, or by your failure to comply with the rules and regulations.
 

7. Insurance

ICS may be able to arrange insurance for loss of or damage to the Shipment, covering the full value of the goods, provided that customer by completing the insurance section of the waybill and pays the applicable charges. Shipment insurance does not cover indirect loss or damage, or loss or damage caused by delays. 

8. Packaging

The packaging of documents or goods for transportation is the shipper’s sole responsibility.ICS accepts no responsibility for loss or damage to documents or goods caused by inadequate or inappropriate packaging.ICS shall not be liable for delay in forwarding or delivery resulting from the customer’s failure to comply with its obligations in this respect.

9. Liabilities not assumed

ICS will not be liable for the followings:
any penalties imposed or loss or damage incurred due to the customer’s documents or goods being impounded by customs or similar authorities and the customer hereby indemnifies ICS against such penalty or loss.
ICS will not be liable for, nor shall any adjustment, refund, or credit of any kind be made as a result of any loss, damage, delay, misdelivery or non-delivery or misinformation or failure to provide information caused by or resulting from:
a. The act, default, or omission of the Sender, Recipient or any other party with an interest in the Shipment;
b. The nature of the Shipment or any defect, characteristic or inherent vice thereof;
c. The violation of any of the terms and conditions of ICS applicable to the Shipment including, but not limited to, the incorrect declaration of the cargo, the improper or insufficient packing, securing, marking or addressing of Shipments;
d. Any events beyond the control of ICS including but not limited to perils of the air, public enemies, public authorities acting with apparent or actual authority, acts or omissions of Customs officials, riots, strikes, or other local disputes, civil commotion, hazards incident to a state of war or weather conditions, or national, international or local disruptions in air or ground transportation networks, criminal acts of any person(s) or entities including acts of terrorism, strikes,natural disasters, disruption or failure of communication and information systems mechanical delay or conditions that present a danger to ICS personnel;
g. Any delay in delivery or ICS inability or failure to complete a delivery due to acts or omissions of Customs or other regulatory agencies
h. Delays in delivery caused by adherence to ICS policies regarding the payment of duties and taxes;
i. The inability of ICS to provide a copy of the delivery record or a copy of the signature obtained at delivery.
 

10. Undeliverable Shipments

Shipments that are undervalued for customs purposes, Consignee cannot be reasonably identified or located, or Consignee refuses delivery or to pay Customs Duties or other Shipment charges, ICS shall use reasonable efforts to return the Shipment to Shipper. This shall be at Shipper’s cost. If it is not possible to return the Shipment, it may be released, abandoned, disposed of or sold without incurring any liability whatsoever to Shipper or anyone else. ICS shall have the right to destroy any Shipment if ICS is prevented by any law or law enforcement agency from returning it in whole or in part to Shipper, as well as any Shipment of Dangerous Goods.

11. Claims

All claims must be submitted in writing to ICS within thirty (30) days from the date that ICS accepted the shipment, failing which ICS shall have no liability whatsoever. Claims are limited to one claim per shipment, settlement of which will be full and final settlement for all loss or damage in connection therewith. Notwithstanding any of the foregoing, no claim for loss or damage will be entertained until all charges have been paid.

12. MISC

Shipments cannot be delivered to PO boxes or postal codes. Shipments are delivered to the Consignee’s address given by Shipper but not necessarily to the named Consignee personally. Shipments that are returned wholly or partially will be notified to the shipper and stored in ICS' premise for a period of maximum 30 days or days notified to the shipper whichever is less. After that period, without any notification the shipment will be used, abandoned or destroyed as per ICS' discretion and shall incur no liability of any kind, therefore. There will be no refund for items partially returned from the origin.
